nbc bay area news. >> thank you, kris. good information there. as things get cold in the bay area, snow is coming down in the sierra. this is what it looked like in kings beach on lake tahoe's north shore. we bring in chief meteorologist jeff ranieri, tracking the temperatures and the snow. >> the snow over the past hour started to fade across the interstate 80 corridor. back behind that, plenty of polar air dropping down across the entire west. it's not just us, but also back into the interior west, cold temperatures everywhere you go. so for tonight, we're expecting by 10:00 p.m., just four hours from now potentially 30s up into the north bay. santa rosa, 36. livermore, 37. san jose, 32. with temperatures like this at 10:00 p.m., it is going to go down colder by tomorrow morning. with those clear skies. the most critical spot for tomorrow morning is the north bay. that's where we'll see temperatures drop the most. you're under the freeze warning as we head throughout our

smith is an experienced pilot. nbc bay area's marianne favro joins us. this is a well-known family in the community. >> reporter: dale smith is very well known for his charity work in the community. tonight, his co-workers are extremely concerned that the search has been suspended until tomorrow morning, but they also remain hopeful. today, search crews focused on a remote area of central idaho where they believe dale smith's plane went down sunday. here at serial tech, the san jose company dale co-founded, his co-workers are focused on hope. >> it's been a couple days now, so the longer this goes on, the more worrisome it gets, but we're still hopeful. >> reporter: dale celebrated thanksgiving with his family at his father's home in oregon. his wife posted this photo on facebook. on sunday, 51-year-old dale took off in his single engine plane with four passengers headed to butte, montana.

they never made it. he reported engine problems and asked for koord nance to make an emergency landing. today his co-workers were encouraged by a new signal coming from the plane's emergency locator transponder. >> the good part of the news is it's in a different location than the cell phones, so to me that might indicate movement. >> reporter: dale's 21-year-old daughter, amber and her fiance, jonathan norton shown in this facebook photo were also on the plane. they plan to get married january 4th. she is a graduate of santa teresa high san jose. dale's son, daniel, and daniel's wife shown in this facebook photo were also aboard the plane. friends of dales describe him as a religious man who taught seminary every morning at this mormon church in south san jose. he is also known for giving back. friends say he was the first to fly his plane with a group of volunteers to new orleans after hurricane katrina hit. sadly, now this rescue mission is for dale and his family.

dale's wife, janice, and their daughter, kricrystal, are at th search command center in idaho hoping for good news. tomorrow they're going to add two six-wing aircrafts in that search effort. sheriffs deputies tell me they're not expecting a lot of snow in the search area overnight, but the big concern is the cold because it is expected it drop down to zero overnight. reporting live in san jose, marianne favro, nbc bay area news. >> thank you, marianne. a missing 13-year-old girl has pleasanton police asking for help tonight. friends and family posted these fliers today. they haven't heard from ana elizarraras for 13 months when she was seen riding in a car with three unknown men. while she left home willingly, she's considered at risk because

of her age. she's 5'5" with black hair, she was last seen wearing a blue/green sweatshirt with the word diamond on front. union members ratified the agreement that gives them an increase of nearly 11% over the next 2 years. the new contract also gives officers a one-time 2% cash bonus. union leaders say the boost in pay is still a long way from where they need to be. >> this beginses to restore some of the pay cuts we took voluntarily years back, and the end of this contract, in 2015, our officers will be making what they made in 2009. >> when they took the 10% pay cuts a few years ago, we saved the jobs of 150 police officers, so we're anxious to try to restore some of that pay. >> the next step now is for the city council to vote on the agreement, and that will take place next week. under pressure after weeks of protests and vigils over the shooting death of a 13-year-old boy in santa rosa by a sheriffs deputy. county supervisors are taking action. the board is voting today to create a community and law enforcement task force.

but not everyone who knew andy lopez is satisfied with that. nbc bay area's jodi hernandez is live in santa rosa. the pressure on the d.a., the police and the county continues, jodi. >> reporter: jessica, protesters are putting pressure on the district attorney tonight. demonstrators have gathered outside the veterans memorial building. some are outside in the front, others are around the side. inside the building, a fund-raising event is taking place. now, demonstrators say they are not about to back down until they get justice for andy. protesters have gathered outside a fundraiser for sonoma county district attorney, joe rabich calling her to throw the book at erik gelhaus who shot ante lopez after mistaking the replica gun

the boy was carrying for a real one. >> this man should not be walking free but held accountable for what happened. there should be no whitewashing of this whole venture that happened here. >> not only was this kid killed, he was overkilled. >> reporter: community members also pressured the sonoma county board of supervisors today to do what they can to make sure a similar tragedy doesn't happen again. >> the sheriff has been very clear he's supportive of looking at these types of training programs. >> reporter: and supervisors accepted a long list of recommended changes including requiring officers to wear lapel cameras. forming a citizens task force. and krconstructing a community park near the shooting scene. >> i did talk about a legacy. i do believe andy has left the community an opportunity to come together, build community and look toward better quality of life. >> the children in this neighborhood need this kind of thing. >> reporter: while many in the

community agree, a park and other proposed changes are needed. first and foremost, they want justice. >> it's not only tragic, it's morally and ethically reprehensible the way he did it. and i think it's criminal. >> reporter: and we're back here live where you can see this protest is under way. again, these folks want the district attorney to file charges against the officer who pulled the trigger not once, but seven times. now, when the district attorney did not return our phone calls today, but she has said in the past there is no one more committed to determining the facts of the case than she is. she is urging the public to be patient as a deliberate step-by-step investigation takes place. reporting live in santa rosa, jodi hernandez, nbc bay area news. after a one-day delay, a new planned parenthood clinic open on the peninsula today. the marmonte clinic in redwood

city near the menlo park border. a handful of protesters, you see here, were on hand to demonstrate against the clinic. neighbors have been circulating a petition saying the clearly marked building will send property values down. not all neighbors agree with that argument or arguments posed by conservative or religious protesters. >> well, i mean, basically they kill children and we're against that. in addition to that, planned parenthood is an atrocious organization. >> people that need to have abortions should be able to have them. >> planned parenthood which also offers birth control, cancer screenings and other information says the opposition had nothing to do with this one-day delay in their opening. they say some of their equipment wasn't quite ready for patients. sunnyvale city council will discuss tonight whether or not to green light a new office park project. the proposed new campus was spread over 55 acres near moffitt, park drive and highway 237 and consist of six eight-story buildings and be

federal investigation, tesla's stock rebounded in a major way today increasing by more than 16%. in fact, one auto analyst says shares are now undervalued. the rebound comes after a german safety inquiry concluded no concerns about two model "s" fires that happened in washington state and tennessee. today's share hit nearly $145, up from its low of $116 late last month. the man who died in a motorcycle crash in san francisco last night is a popular television host. 38-year-old william beckwith of hgtv. beckwith lived in san francisco and was a co-host of hgtv's show called "curb appeal" that did makeovers of home ex-tiexterior. his motorcycle and another car crashed. he was taken to sf general where he was pronounced dead. reports of a dump truck slamming into a building in cupertino today had first responders fearing the worst. the building turned out to be an empty detached garage.

the truck sheered off a utility pole. the garage sits on busy foothill boulevard near stevens creek. commute traffic turned into a mess after sheriffs deputies closed foothill. no word on what caused the truck to veer off that road. it feels like the holiday time. jeff ranieri in here to update us with our freezing temperatures or near-freezing temperatures overnight. >> yeah, we've got a lot to digest here. look at these temperatures. upper 40s currently. just a few nights ago, that was what we had for the overnight lows. there are a lot of room for the numbers to continue to drop as we head throughout tomorrow morning. the coldest, the north bay averaging 48. you're being rivaled in the south bay, actually in the last minute now is also averaging 48 degrees. and 49 throughout the peninsula. what i want to take you to is here across the south bay, that's where tomorrow morning temperatures are expected in the upper 30s at 8:00 a.m. also clear skies. and watch this. by 2:00 p.m., we're not going to see too much warming. definitely jacket weather in place here as we head throughout tomorrow's forecast. now, let's get that 24-hour look

in here. and what you're going to see is most of the temperatures are going to be averaging right at about 50 degrees. so let's find out in that forecast how things are going to play out. i think the worst of that cold weather is going to be up here into the north bay. that's where that freeze warning has been issued for tonight. also for tomorrow morning. and that's where we'll likely find those isolated areas of 20s. for the south bay, not that cold for tomorrow morning, but certainly very chilly for us. 36 expected at 7:00 a.m. by the noon hour, expecting 50. the peninsula, upper 30s at 7:00 a.m. get the heavy jackets out. also the layers. even in san francisco, 41 degrees. near record-setting lows for you. then you can see by the lunchtime, temperatures in the low 50s. we'll also take a look here across the north bay, east bay and tri valley. temperatures pretty much in the 20s and 30s to start. see up here in the north bay, that's where we'll have 28 to begin at 7:00 a.m. and not only is it going to be cool here as we head throughout tomorrow's forecast, but take a look at thursday. even colder.

president obama saying the website for the affordable health care act is working well for the vast majority of users. what isn't working well, though, in california, is this political brand. a new field poll, take a look, shows 43% of californians disapprove of mr. obama's job performance. that's an increase from 35% in july. nbc bay area political analyst larry gersten joins us. larry, is this a cause for democrats to be concerned even here in california? >> they may not say so, but yeah, they are concerned on several fronts. look, to begin with, the president lost support among key constituencies. take a look at the growing ranks of disapproval. these are pretty important. women up to 40% from 27% a few months ago. latinos, 34% disapproving compared to 18%. union households, up to 43% from 25% a few months ago. these were major pillars of the democratic coalition in 2012, and they are abandoning ship.

>> usually here in california, we're kind of our own island, but is the disapproval kind of similar now across the country? are we reflecting that is. >> yeah, it is around the country. you wouldn't expect it here, you know, but why here above all places? blue california. well, major disappointments in key policy areas such as immigration. really a key issue here. and unemployment rates as well. that's 2% above the national average. so, you know, to be fair, some of this, by the way, goes with the territory. some of the concern comes along with the obama administration. he's well into his second term. you know, for many he doesn't seem to have that zip, the spark he had during the first term. >> politics, there's always a string attached. the implications down the road, we'll look at the midterm elections next year and, of course, 2016. >> yeah, there could be big ones. the 2014 midterm elections could be costly for the democrats here, especially in state legislative races where you may remember they'll try to hold on to the very precious 2/3

majority which is neutralized republicans. also, with less enthusiasm among key constituencies, there will be a few congressional seats in play in northern california as well, like jerry mcnerney and john garamendi come to mind. critical seats for those folks. then there's the 2016 presidential election. the big one. with these numbers, republicans may want to invest here which at minimum will force democrats to defend their turf and spend money that they might have spent elsewhere here instead. so, yeah, you say 2014, it's a year away, but you know what, with data like this, huh-uh, for republicans, it can't come fast enough. >> yeah, it sets table for a lot of things. thank you, larry. still to come, finally a ray of light for obama care. the president said today the revamped website is working for, quote, most americans. but what does he mean by "working"? we have a reality check coming up for you. i'm janelle wang. a cause of death finally

escalation in the process. and, i mean, it just seems ridiculous to me at this point. >> reporter: it might be ridiculous to some b.a.r.t. riders, but a serious reality to transit workers and management. >> a lawsuit is going to delay a resolution to this contract dispute which has already gone on far too long. >> reporter: b.a.r.t.'s two largest unions are suing b.a.r.t.'s board of directors for, in their words, unlawfully reneging on a final and complete labor agreement. >> we filed a lawsuit to have the courts tell them, you must take the complete package. >> reporter: both sides reached a tentative agreement on a labor contract in october. weeks later, b.a.r.t.'s board of directors discovered a new issue and voted to reject the contract unless the union removed a provision granting six weeks a year of paid family leave. >> a mistake was clearly made. it should have never been part of the tentative agreement. >> reporter: a problem the union feels can only be fixed by a judge or maybe even a jury. >> the board of directors is not

in any position to cherry pick which provisions it intends to honor, and which ones it does not. >> reporter: so here we are, not back at the bargaining table, but at a stalemate. a lawsuit has been filed. both sides say that they want to talk, but no talks have been scheduled. reporting live in san francisco, i'm cheryl hurd, nbc bay area news. >> the saga goes on. thank you. asleep at the controls? today, the ntsb revealed new details on what may have caused a commuter train to derail in new york city. janelle wang with our "world tonight." >> the engineer zoned out moments before the crash. the ntsb is looking into whether william rockefeller nodded off when the train was traveling at 82 going into a 30 mile per hour zone. the 36-year-old veteran engineer worked the nightshift for many

years. a couple weeks ago he was transferred to the early morning shift. as for mechanical failure, doesn't look like it. the ntsb says a proper brake test was done prior to the train leaving the station that day. >> based on these data, there's no indication that the brake systems were not functioning properly. >> the crash on sunday killed four passengers, a union official says the engineer is extremely traumatized and distraught over the loss of life. it was suicide. today a final ror was released on ariel castro's death. it concluded the 52-year-old did hang himself in his prison cell in september. shortly after being convicted of kidnapping and raping three cleveland women. a prison report has suggested castro may have accidentally died while he was committing a sexual act of autoerotic asphyxiation. broke and officially going bankrupt. today a federal judge confirmed what detroit has been saying for months now and paved the way for the city to declare bankruptcy. it's the largest city to declare bankruptcy in u.s. history.

detroit is $18 billion in debt. major cuts in pensions are expected for city workers. vice president joe biden is wrapping up his trip to japan, where the focus was china. he and the japanese prime minister discussed how to deal with china's declaration of the east china sea which until recently has been known and still is international airspace. chinese says all aircraft including passenger airlines must now get approval to fly through the zone or face possible military action. vice president biden will travel to beijing tomorrow. in the hot seat. today, the editor of "the guardian" defended the newspaper's decision to publish information from edward snowden. the editor said he only released about 1% of the material that was given to them by the former nsa contractor. scotland yard, meantime, confirmed today it is investigating whether "the garden" should face terrorism charges for publishing high-level security secrets. and that is your "world tonight." >> thank you, janelle. take a look. an amazing story of survival. a man is found alive inside the

hull of a sunken tugboat after being trapped underwater for reportedly three days. this is video released of the rescue. back in may. the divers finally got to him. he was 60 feet underwater and was wearing shorts and drank soda to stay hydrated. the other 11 members of his crew died when their tugboat capsized off the coast of nigeria. now to an nbc bay area follow up. san jose police identified the man believed to be responsible for a violent chain of events on thanksgiving day. investigators say albert vasquez of san jose began his crime spree by stabbing three people at an apartment complex. he then allegedly attacked a minivan driver, stole the van, and barreled on to interstate 680 going the wrong way. police say he sped through residential streets at 70 miles an hour. police eventually shot and killed vasquez shortly after he rammed a patrol car. all three stabbing victims are expected to survive. no word, tonight, on what

sparked that rampage. there's a good chance you will smile with this story. travelers coming through sfo are getting a special treat this week. one that will help make flying a little less stressful. eight certified therapy dogs will be walking the terminals offering free stress relief to passengers. look at all those smiles. part of a new program by the spca called the wag brigade. spca volunteers will handle the dogs who will wear vests with the words "pet me" on them. >> we just want to make sure we can provide as much stress relief and comfort for the passengers who are hanging out especially during the hectic holiday season. >> look at that. >> so cute. >> it is great. the dogs have been selected for their temperament and airport suitabili suitability. the goal is to make travel more enjoyable for passengers and those of us dropping off our friends and family members.

fast food workers in the east bay claim that jack in the

box is retaliating against them for wanting better wages and conditions. now they're taking their complaints to the justice department. this started in august when employees in oakland organized a strike. since then, more than 60 workers have been fired. the employees believe managers targeted them because of their race, immigration status, and for speaking out. >> so i think the answer, the strategies and reasons have varied. some were not given any reason. they were just told that their last shift would be in a couple days. >> some of the employees say they were forced to go through extensive immigration checks as well. the company is not commenting specifically about the complaints filed with the doj, but it did release a statement saying, "jack in the box is sensitive to the fact that some loyal hardworking people have been affected by these terminations but there's nothing they can do if the employees do not have legal documentation." well, this doesn't happen very often. in fact, it happens very rarely. a 100-year-old bay area woman

became a u.s. citizen today. suke haan yu cheng spent most of her life living in hong kong. when she was just a mere 80 years old she decided to move to canada to join her son and daughter-in-law. at 90 years old, she came to america where she lives with her daughter in fremont. cheng speaks cantanese. her daughter told us what she likes about the bay area. >> she likes about the weather. >> the weather? >> yeah. and the people. >> she likes -- she's a perfect u.s. citizen. she's talking about jeff ranieri's weather forecast. in the past 50 years, less than 20 people, fewer than 20 people 100 years or older have been naturalized as u.s. citizens. >> she's so sweet. holding up her little american flag. >> she looks great doing it as well. >> and jeff, she was giving you kudos. >> she loves our weather. i'm always looking for a new weather watcher. tell her to bundle up tonight. >> we've been very busy with the new weather wall. always accepting the new weather

the white house says a million people visited healthcare.gov yesterday. a scenario that was unthinkable a few weeks ago. >> the president has been careful not to declare this a victory but kept his promise, an operational website by december 1st. in tonight's "reality check" nbc bay area's sam brock examines whether that statement is really true. it's december 3rd, sam. >> raj, jessica, time is up. it's important to note, though, things are running fine in california. we have our own exchange here. healthcare.gov used in 36 other states had well-documented problems. now, looks like the front-end

issues have been resolved. people can largely access and use the site. what good does that do if on the back end insurance companies can't get accurate information? your information. are the technical glitches on healthcare.gov fixed? president obama says a month of troubleshooting from experts has improved the site's functionality. >> it's working better now and it's just going to keep on working better over time. >> reporter: the white house claims 50,000 users at a time, and 800,000 per day can now access healthcare.gov. can we verify that? >> like anything else in this world, there is no other outside independent way to evaluate it, although i think they will ultimately show how many people enrolled and the numbers will be transparent and they'll be putting out the report. i think these are good reasons to believe him on this one. >> reporter: ken jacobs has been closely monitoring the affordable care act at berkeley's labor center and feels confident about where things are headed on the front

end. success is not just about getting signed up on the website. health plans also need the right consumer information. and on the back end, there have been issues. 834 transaction form is what insurers receive with your enrollment information, your policy information, and other critical details. in some cases, these forms have been submitted with mayor inaccura inaccuracies. the federal government says it's largely addressed the problem. >> more than 80% of the 834 production errors were actually due to one bug that prevented a social security number from being included in the application. that bug has been fixed and is now working properly. >> reporter: but insurance companies aren't buying the explanation. they tell nbc bay area they don't think one bug was responsible for causing 80% of the problems. so who's right? >> it is something that will have to be tested over time. and right now, you know, we're in a public relations war, of course. >> reporter: marianne mulkey with california health care foundation says she's in no position to know which side is

right. but if the back-end problems do persist, here's what she says you can expect. >> if there's a glitch in that process, anywhere along the line, a handoff that isn't made or an inaccurate piece of data, then that consumer potentially will show up at the doctor and it won't be known how much they owe or the plan will pay and it will turn out that the consumer really wasn't eligible in the first place. >> and there are all kinds of nightmare scenarios of health plans don't have the right information. now, the government says it's addressed 80% of these reporting issues with that one bug fix. even if that's true, 80% out of how many people? what's the error rate here? were 2,000 people affected? 10,000? 100,000? the point is, we don't know, and nobody in the government is saying. until we have answers to these critical questions, the president gets a big incomplete on this promise. i'm sam brock. that's today's "reality check." back to you. >> very interesting. thank you, sam. let's turn things over to

jeff ranieri. we want to talk about the near freezing temperatures we'll deal with over the next couple days. >> it's going to be dropping down and quickly tonight, jess and raj. right now some of the coldest weather we're pinpointing in the north bay. that's where we are running 15 degrees cooler at this hour. into napa, i have no doubt this will be one of our top coldest locations as we head into tomorrow morning. speaking of numbers dropping, take a look outside right now. our sky camera network in the north bay. currently 46 degrees. i do think in about two to three hours we'll definitely have 30s across the bay area. i want to take you to the south bay. it wasn't overly cold this morning. look at what's coming our way for tomorrow. 38 degrees expected at 8:00 a.m. also clear skies, and that's going to mean, well, temperatures only going up to 50 by tomorrow. we have so much cold air in place. so let's get a look at where i do think the freeze warning will be the largest concern tonight. that's going to be for all of our north bay counties here stretching from santa rosa down toward mill valley and, of course, some of the usual interior valleys of napa and

also sonoma. again, you're into that freeze warning for tonight. temperatures ranging anywhere from about 25 to 36 degrees. then as we head throughout wednesday night, also into thursday morning, all of the bay area under our freeze warning except one spot. that's san francisco. just doesn't look like you're going to get cold enough at this point. so let's take a look at what's driving all this cold air. there definitely is a distinguishable difference from plain old cool air. what's happening is the jet stream is positioning in just the right spot to drag down this wind here directly from the north. it's coming from a polar air source. that's helping those temperatures to drop, and i don't really see this shifting for the next two to three days. going to stay in place. let's take you into the temperatures for tomorrow morning. we talked about it being chilly. 29, santa rosa. 27 in napa. could be the coolest. we'll advance this into thursday morning. cooler into the north bay. temperatures in the low to mid 20s. back here for the east and south bay, you'll get in on some of your oldest temperatures as we head throughout the thursday

morning forecast with possibly 32 in san jose. so let's take you to the microclimate forecast for wednesday. take a moment, find your area. what you'll see here, you'll start out with the jacket weather, you're going to finish with also very chilly temperatures. san jose, 52. akrons the peninsula, anywhere from about 50 to 51 degrees. also, san francisco, low 50s and sunny skies. north bay, east bay and also the tri valley, temperatures 50 to 53. from that record-setting heat this past sunday with 70s in the tri valley, you're going down to the 50s for tomorrow. then as we look ahead in that forecast, that storm track is going to stay active here across the bay area. we're going to track another storm system that will be developing eventually in the pacific. by friday, temperatures staying on the cool side. clouds increase. also the possibility of showers in the forecast. you'll see here, you guys, the forecast model starting to bring down that next rain as we head throughout friday night. of course, we'll be here to track that for you in the next coming days. >> thank you, jeff. squaw valley was twittering earlier tonight saying they're

they're looking to fine tune their team any way they can to make the push to get past the first round of the playoffs. they added jim johnson, closer from the baltimore orioles. they got him in a trade for weeks. they added gregerson, reliever from san diego. they traded seth smith to san francisco to get gregerson. they're about to add a starting pitcher, scott kazmir on a two-year contract. they're improving the pitching staff. the question is are the a's going to turn around and deal starting pitcher brett anderson? what do they get for brett? wouldn't be surprised if they pull another trade. they may trade brett anderson. we'll see if they continue to add to make this year's team stronger. let's move over to football. this weekend the top two teams in the nfc west square out, seahawks flying high in first place, 49ers trying to catch them. good for a little redemption after pounded in week two up in seattle. with all that said, 49ers are a focus on this sunday's opponent. >> we definitely want to come out at home and play well and show everyone what we could do
